A.D. 1220.

IN 1220, "the magnates and faithful" of the realm made a "gift" to the King, for the discharge of his urgent debts and for the defence of Poitou, of 2s. on every plough as yoked (sicut juncta fuit) at Midsummer of that year.

By writs dated at Oxford on the 9th of August, the several sheriffs were ordered to summon full meetings of their respective "counties" and to cause two suitable knights to be elected in each, to assist them in making the necessary assessments and collecting the money. The assessments and the money were alike to be delivered in London on the morrow of Michaelmas. Archbishops and bishops and their villeins, and the monastic orders of Citeaux and Premontre were exempted from the assessment; [1] the Templars and the Hospitallers obtained respite. [2]

By subsequent writs of the 7th of September, the exemption was extended to all ecclesiastics, and by further writs of the 19th of October to all their military and free tenants, upon a definite understanding that the ecclesiastics would themselves collect the carucage from them. [3] It will be observed that these last writs were not issued until more than a fortnight after the date originally fixed for the payment of the money. Having regard to the means of communication in the thirteenth century, the task imposed upon the sheriffs in August seems to have been impossible.

Although there was some opposition to the tax, a considerable part of it had been received by the 24th of November. [4] None of the sheriffs, however, appear to have rendered their accounts of the carucage by May 1223, and there are scattered notices of it in records of even later years. [5]

There has been some difference of opinion on the question whether the carucage of 1220 was levied on plough-teams or on plough-lands. [6] The main facts, as revealed by the records, may be stated in a few words.

In the first place, although the government of Henry III was not necessarily bound by precedents of the previous reign, it seems desirable to note the mention of the carucage of the year 1200 by two independent chroniclers:- "Collectum est caruagium in Anglia, scilicet tres solidi pro quolibet aratro" [7] "Exiit ergo edictum a justiciariis regis per universam Angliam ut quaelibet carruca arans tres persolveret solidos". [8]

Secondly, the royal writs of 1220 seem clearly to point to the teams as the subjects of the tax, the words "juncta" and "juncte" being inapplicable to the land.

Thirdly, the account for Buckinghamshire states that there was no caruca at Bradenham in 1220. In this connexion it is interesting to note that, in 1086, the land there was sufficient for two ploughs and that there were actually two ploughs there. [1]

Fourthly, the assessment for Hertfordshire contains numerous references to "teste", presumably heads of cattle, which were, in almost every instance, charged at 3d. apiece, that is to say one eighth of the 2s charged on the caruca. [2] If then the caruca was a full team of eight oxen, this rate was normal.

On the other hand, the same assessment for Hertfordshire mentions a third of a caruca at Graveley and another third at Panshanger. Furthermore, in the accounts of the collectors for Berkshire and for the Honour of Wallingford various fractions (partes) of caruce yielded odd amounts such as 2d., 3 1/2d., 7d., 7 1/2d., 8d., l0d. and l7d. which cannot represent any integral number of oxen. In Northamptonshire there are specific mentions of fractions of the caruca, two-thirds, one-third, one-sixth and even one-twelfth. A half-ox (semibos) mentioned in 1086 seems to have represented one-sixteenth share in a full team. [3]

The identification of documents relating to the carucage of 1220 has been greatly facilitated by the discovery of abstracts of some of the accounts on the earliest of the series of Foreign Rolls of the Office of the Pipe.

BERKS.- The heading of a roll for this county shows that the assessment was not made there until the fifth year of the reign of Henry III, that is to say after the 28th of October 1220. The letter "T" written several times in the margin shows it to be the roll which was produced at the Exchequer at the audit of the account, as mentioned in the Foreign Roll. This original was copied into the Book of Fees, but the compilers of that work do not appear to have had access to a supplementary list, which is now printed for the first time. This account of "arrears" gives the names of various laymen who are not mentioned in the original collectors' account printed below. William de Wancy is named in both the documents as one of the assessors and collectors. In order to ascertain the number of "caruce" belonging to ecclesiastics in Berkshire, it is apparently necessary to add together the figures in the two lists. It may be noted that the "arrears" collected from laymen at Winterbourne and Aldermaston bring the totals for those places to even sums of money representing whole caruce.

BAILIWICK OP WINDSOR.- An assessment at the rate of 2s. on the "caruca" on certain places not included in the main assessments of Berkshire appears to have been overlooked by the compilers of the Book of Fees. The total amount collected was 16l. 6s. and the Foreign Roll shows that this was the precise sum paid over by Engelard de Cigogne to the general receivers of this carucage at the New Temple in London.

GLOUCESTER.- An assessment for this county is entered in the Book of Fees. The sum total corresponds exactly with that for which Ralph Musard, the sheriff, accounted at the Exchequer, as shown on the Foreign Roll.

HONOUR OF WALLINGFORD.- There is an account of Henry of the Exchequer for carucage at the rate of 2s. collected in this Honour in the counties of Oxford, Buckingham. Northampton, Berks, Wilts, Middlesex and Surrey. The sum total corresponds exactly with the amount which he is recorded to have paid at the New Temple, less some arrears which are mentioned in this document and in the Foreign Roll alike. It may be observed that in the original roll all the statements as to number of caruce at each place are clearly additions.

OXFORD.- There is a general account of the carucage in this county. The sum total corresponds exactly with the amount for which Ralph fitz Robert and Gilbert of Finmere, the collectors, accounted at the Exchequer.

NORTHAMPTON.- An account of the receipts for carucage in this county may, although undated, be referred to the year 1220, for it states that the Bishop of Salisbury had, by the king's order, collected the amounts due from the lands of Roland son of Simon of Lindun and Richard of Hendred, and his authority to do so is recorded in a contemporary roll of the Chancery under date of 1 September 1220. [1] The names of the assessors and the amount collected correspond exactly with those given on the Foreign Roll.

NORFOLK AND SUFFOLK.- A roll for these counties gives the total number of caruce in each hundred and deducts therefrom those belonging to ecclesiastics. The figures for both counties agree with those of the Foreign Roll.

HERTFORD.- A roll for this county is specifically dated as belonging to the fourth year of Henry III.

HUNTINGDON.- A brief account of carucage in this county "in the time of Falkes de Breaute" on a single piece of parchment, was presumably written soon after his fall in 1224. As it relates to a levy of 2s. on the "caruca", it may be founded upon an account of the year 1220. The total number of caruce mentioned in it differs from that given on the Foreign Roll by a quarter of a caruca, which yielded 6d.

BUCKINGHAM AND BEDFORD.- Seventeen years after the grant of the carucage of 1220, the Exchequer issued a writ, perhaps a series of writs, ordering immediate enquiry as to the assessments and payments made in connexion therewith. At a still later date, inquisitions were held in the counties of Buckingham and Bedford, which resulted in the preparation of lists naming the different persons to whom the money had been paid. In Buckinghamshire, most of it seems to have been paid to the authorised collectors. In Bedfordshire, many payments had been made to Henry of Bath, who was under-sheriff from Michaelmas 1220 to Michaelmas 1223. One payment had been made to a servant of Falkes de Breaute, who was Sheriff from Michaelmas 1217 to January 1224. The writ and the inquisitions will be found in the Appendix.

VARIOUS DATES.

IT has been observed already that few of the documents transcribed in the Book of Fees are also transcribed in the Red Book of the Exchequer. A notable exception is a series of lists of serjeanties in different counties, given consecutively in the Red Book, [1] but distributed in various parts of the Book of Fees, which, moreover, has lists for Sussex and Cambridge and Huntingdon that do not appear in the earlier volume.

In the Book of Fees, many of these lists are entered twice and one is entered three times, one version bemg almost invariably headed- "De Testa de Nevill", and another- "De seriantiis arentatis per Robertum Passelewe tempore Henrici Regis, filii Regis Johannis". Other lists were apparently derived exclusively from the latter source. Inasmuch as Passelew's commutation of serjeanties is known to have been made between 1247 and 1250, it might at first sight be supposed that these lists were drawn up by him and his colleagues at that period. They are, however, considerably earlier, as will appear below.

In explanation, it may be suggested with some confidence that, when Passelew was about to begin his enquiry, he was supplied with lists of such serjeanties as were recorded at the Exchequer, that these lists were returned by him on the completion of his task, and that they were thenceforth preserved with his report. The Exchequer would thus have at least two series of these lists, one kept in the receptacle known as "Testa de Nevill", and the other, consisting of copies, preserved in a coffer, hanaper, or bundle, labelled "Serjantie arentate per Robertum Passelew," etc. as above.

It is abundantly clear that the parallel lists of serjeanties printed below from various parts of the Book of Fees and those collected under a general heading in the Red Book of the Exchequer were derived from a common original, which no longer exists. Not only is the sequence of the names practically identical in the deferent counties, but scribal blunders occurring in one volume are generally to be found in the other also. Four instances will suffice. In the list for Essex, the word "glavie" has been transferred by both the copyists from the second entry to the third, thereby making nonsense. A misreading has in both books converted Overton in Lancashire into "Cuerton" or "Querton". In the parallel lists for Wiltshire, Warin Doinel appears as Warin "Puninel", and Geoffrey Luveraz as Geoffrey "Luterel". This last error shows that the three versions now extant were derived from a list prepared at the Exchequer, rather than from an original return from Wiltshire, for whereas Geoffrey Luterel had no land in the south of England, he was known at Westminster as one of the principal ministers of the Crown.

In the printed version of the Red Book, the editor has tentatively ascribed the lists of serjeanties there given to the period between 1212 and 1217, and has accordingly affixed these dates in the margin. Subsequent researches, made during the preparation of the present volume, show that these limits are much too narrow.

336 VARIOUS DATES.

Having regard to chronological difficulties, it is altogether impossible to regard these lists of serjeanties as a uniform series belonging to any particular year. They were probably copied from compilations made at the Exchequer, and posted up from time to time in a very casual manner. In some cases, notably in the lists for Cumberland and Northumberland, additional names have been inserted without cancellation of the names of previous holders of the serjeanties mentioned. This has led to contradiction and confusion.

In general character and in historical value, these lists of serjeanties are more similar to the so-called "inquisitions" in the Red Book than to the rest of the material collected in the Book of Fees. There is reason to believe that all of them were mere extracts or abstracts from returns made by sheriffs or by justices in eyre at different times in the first quarter of the thirteenth century. Owing to the loss of many of the records of the eyres of the period, it is now difficult to assign particular lists, or sections of lists, to definite years.

The following notes upon some of them are more or less tentative. They may be amplified hereafter by persons who have studied the history of the different counties.

KENT. The list consists of extracts from a record of the eyre of 1219, in which the names of the Serjeants occur in the same sequence. [1]

SURREY. Peter son of Henry fitz Ailwin, mayor of London, who is entered as holding Addington, was dead in 1207. [2]

SUSSEX. Alan of Woolbeding, who is entered as holding by serjeanty, was presumably the predecessor of Roger of Woolbeding, who paid relief in 1211 and who was entered as holding by the same serjeanty in 1212. [3]

SOUTHAMPTON. The long list for this county is divided into two parts in the Book of Fees. Both of them show a close resemblance to the sheriff's return of 1212.

WILTS. The list seems to have been compiled from several sources. An entry mentioning Warin fitz Gerold as the king's chamberlain can hardly be later than May, 1218, when he was dead. [4] On the other hand, the mention of the successor of Iseult Biset suggests a subsequent date, for that lady was living in 1219 and perhaps in 1222. [6] The second of the two entries concerning Robert Doinel presents a difficulty, for the marshalship there attributed to him had passed away from the Doinels before 1166. [6]

SOMERSET and DORSET. The list does not appear to be founded either upon the return of the sheriff in 1212, or upon that of the justices in eyre in 1219. In both those years, Geoffrey de St. Clair held Stapleton in Martock

by serjeanty. [1] Robert de St. Clair obtained livery in 1223. [2] The person of that name mentioned in the list may, however, have been a predecessor of Geoffrey.

HEREFORD. Most of the persons here named as Serjeants occur also in the sheriff's return of 1212, but not in the same order. There are moreover some variants which seem to indicate that part of the list printed below was prepared before 1212. Thus Gilbert of Bray who figures in this list as a Serjeant has by 1212 been replaced by Auda his relict. [3] That the list is not in its present form a homogeneous return of any one definite year is shown by the fact that the Caperun serjeanty is entered twice. In the first case, Hugh Caperun is stated to hold half a hide of land by some service unspecified. In the second case, Agnes Caperun is stated to hold an unspecified amount of land by a particular service. The return of 1212, printed above, shows that her holding consisted of two virgates, that is to say half a hide, the exact amount held by Hugh Caperun, who is not mentioned among the Serjeants of 1212. The inference is that the entry concerning Agnes Caperun printed below was an addition to the original list, made at the Exchequer by a clerk who did not realise that there was only one Caperun serjeanty. Further research may reveal other additions of a similar kind.

BERKS. The version of the list given in the Book of Fees differs in several particulars from that given in the Red Book of the Exchequer. Neither of them can, however, be regarded as a satisfactory copy of an unaltered original. Some facts relating to West Hendred are instructive. It has been seen above that, in 1212, Richard of Hendred was returned as holding a hundred shillings of land by the serjeanty of keeping ale. [4] So again, in 1219, the justices in eyre reported that he held a hundred shillings of land at West Hendred by a service of ale in the king's buttery. [5] Turning now to the Red Book of the Exchequer, we find that William of Hendred is entered as holding a hundred shillings of land without any specified service, while Richard of Hendred is entered as keeping ale without any specified land. Inasmuch as Richard is known to have obtained livery of the lands of his father William in the financial year ending at Michaelmas 1209, it seems clear that the entry naming him is later than the entry naming William. [6] So far the case is exactly parallel with that of the Caperun serjeanty in Herefordshire. One of the manuscripts was, however, altered again after the death of Richard of Hendred, which must have occurred in 1219 or 1220. [7] In the list supplied to Robert Passelew in 1250, William of Hendred and Richard of Hendred are alike replaced by Adam, or Ada, of Hendred, but the clerk who made these changes did not venture to amalgamate the two entries. No Adam or Ada of Hendred has yet been identified.

ESSEX and HERTFORD. The list may be compared with a different list of the same period give in the Red Book of the Exchequer and apparently

extracted from the lost return made by the sheriff in the summer of 1212. [1] The sequence of the names is, however, different, and there are various discrepancies.

NORFOLK and SUFFOLK. The last three words of the fourth entry must have been added after the death of Lauretta Picot, which seems to have occurred in the early part of the year 1224. [2] The fact that Robert of Worstead and William of Hastings are entered twice in the list might suggest that they held land by serjeanty in both counties. On the other hand the list includes two Serjeants called Ostricer and two called Cordebof. The John Cordebof mentioned in the seventh entry may be the person of that name who was succeeded by his son Hubert in 1205. [3] If so, the list must have been compiled from at least two documents of different dates. Inasmuch as Hubert Cordebof held land at Banningham and Mendlesham by serjeanty in 1212 and 1219, it seems possible that the "Hugo" of the text printed below is a clerical error for "Hubertus".

SALOP. The first nine entries in the long list for this county were probably founded upon the record of some eyre held in the early part of the reign of John. In all the remaining entries, the names of the Serjeants are identical with those furnished by the sheriff in 1212, and the sequence in which they occur corresponds also with that of his return printed above. The clerk of the Exchequer who prepared the list was careful not to re-enter five serjeanties which already figured in the earlier part of his own compilation.

STAFFORD. The list for this county seems to have been compiled in a similar manner, the first seven entries being based upon an early record now lost, and the last two being taken from the return made by,the sheriff in 1212.

LANCASTER. The list is a compilation from two or, more probably, three sources, of different dates. The first person mentioned in it, Geoffrey of Gressingham, was dead as early as the year 1205, when the marriage and inheritance of his daughter and heiress, Alice, were sold to Adam fitz Adam for the benefit of his son Thomas. [4] This Thomas fitz Adam occurs later in the list as holding land at Gressingham in virtue of the forestership, which had belonged to his father-in-law. Little or nothing is known about the second person mentioned in the list, Ketel of Gressingham. Of the next four persons mentioned, three occur in lists of the years 1212 and 1219 printed above, and one occurs only in the list of 1212.

From the seventh entry, beginning "Henricus de Walton", down to the end, the whole of the list printed below appears to be taken directly from the return of the justices in eyre of the year 1219 printed above.

YORK. Eight of the nine entries in the list for this county agree almost word for word with the return of the justices in eyre of the year 1219. The last entry is an addition from some other source, for the two persons named in it, Robert of Geveldale and Thomas of Geveldale, are clearly identical with Robert the Balister and Thomas of Walkingham, already entered as holding land at the same place by the same service.

CUMBERLAND. The list for this county is a compilation from at least three sources. In the first section of it, we find Adam of Levington, who was dead in 1210, Odard fitz Adam, who was dead in 1208, and Otes of Bochardeby. In the second section, we find Richard of Levington, the son and successor of the aforesaid Adam, and William the son of Otes of Bochardeby, who did not succeed his father until after Michaelmas 1210. [1]

The whole of this second section appears to be based upon the return made by the sheriff in the summer of 1212 and printed above. [2] The third section of the list comprises only the last four entries.

NORTHUMBERLAND. The first part of the list for this county can hardly be later than 1210, for Sewal fitz Henry, who is entered in it as holding by a serjeanty undefined, is known to have died in the spring of that year. [3] The last entry in the list, stating that the heir of Philip of Ulecot holds Matfen and Nafferton by the serjeanty of being coroner, must, however, be at least ten years later, for Philip of Ulecot did not die until the autumn of 1220. [4] He was the successor of Sewal fitz Henry in the office of coroner.

As stated above, some of the lists of serjeanties exist in duplicate and others in triplicate; all are alike mere copies of documents of questionable origin; neither of the three series has any claim to superior authority. Under these circumstances, it has not been thought necessary to base the text exclusively upon the copies made from documents formerly in the "Testa de Nevill" (here called N), or upon those made from documents formerly in Passelew's collection (here called P). All important variants are, however, mentioned in the footnotes, which also give some emendations from the version in the Red Book (here called R) and other sources.
